Obama-SCOTUS Case #3/Berg Conference Set For Jan. 9-'09

Interesting to note that the conference is set for the day after Congress meets to count the Electoral college votes.

This will be the third SCOTUS conference on the Obama no-certificate issue, but just the first one challenging the Hawaiian-born claim. The two cases already rejected ignored were based upon the aspect of the British citizenship of Obama's father, which under British law at the time would automatically have made Obama a British subject also, regardless of birthplace.

Just for the sake of being well informed on that point is this quote:


"(1866) Representative John Bingham of Ohio, who is considered by many the "Father of the Fourteenth Amendment", is quoted in Donofrio's essay as saying the following:

"[I] find no fault with the introductory clause [S 61 Bill], which is simply declaratory of what is written in the Constitution, that every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen…[6]"" here

*January 8 is the next critical day. That’s when Congress will meet to add up all the Electoral College votes. U. S. Electoral College Public Law 110-430 changed the date of the electoral vote in Congress in 2009 from January 6 to January 8. This date change is effective only for the 2008 presidential election.
